It has been confrimed by Microsoft that an American Xbox 360 with a US Xbox LIVE Gold account can’t buy games from the Japanese Marketplace that are not available on the American Marketplace and vise versa.
If you try you will get this message:
“This item isn’t available from your current location.”
Microsoft:
“The portfolio of titles offered through Games on Demand will vary by region, based on regional title availability.”
